Mexico: Senate approves legalization of recreational cannabis with possibility of self-cultivation

The Mexican Senate yesterday approved a bill to legalize cannabis, in a historic vote that paves the way for the world's largest legal cannabis market, announced to Reuters. Eighty-two senators voted in favor of the new proposal, 18 against it and seven abstained. Now, all that remains is for the initiative to pass the Chamber of Deputies.

If enacted, the new legislation will allow consumers to own up to 28 grams and grow up to four plants at home. This law will represent a huge change in a country where drug cartel violence has killed more than 100 people in recent years. The Supreme Court ruled in 2018 that recreational cannabis should be allowed, just a year after lawmakers legalized it for medical use.

Adult sales at authorized companies will be allowed, as long as the product meets the maximum levels of psychoactive ingredients. The law provides, however, that use by minors or driving under the influence of cannabis is prohibited.

President Andres Manuel Lopez Obrador has not publicly supported the legalization effort, but neither has he opposed it, and government officials such as Interior Minister Olga Sanchez have openly called for a shift to legalization and regulation. Lopez Obrador's centre-left Morena party, which backed the initiative, holds a majority in both chambers of Congress with its allies. The bill aims to “improve living conditions” and “contribute to the reduction of crime linked to drug trafficking”, according to its text.

Some companies in the cannabis sector have already expressed interest in a future legal market in Mexico, including Canopy Growth of Canada or The Green Organic Dutchman, as well as a unit of Medical Marijuana Inc.

Mexico is thus preparing to be the third country in the world to fully legalize cannabis use, after Uruguay and Canada, in addition to several US states.
