Italy: Court suspends Meloni government decree banning the sale of CBD

The legal situation of CBD in Italy has taken another turn. After Giorgia Meloni's government published a decree that prevented the commercialization of cannabidiol (CBD) in the country and placed it on the list of substances for medicinal use only, the Lazio Regional Administrative Court ruled that the commercialization of CBD cannot be blocked. or the seized goods, said the newspaper La Repubblica.

The decree of August 7, 2023, from the Meloni government,had come into force on September 22nd and suspended the previous authorization, to start treating all CBD products as narcotic substances or for medicinal use only. Meloni's rule stated that “compositions for oral use or ingestion based on cannabidiol extracted from cannabis” should be added to the medicines table, section B of the consolidated law regulating narcotic drugs and psychotropic substances, but has now been suspended until 24 of October.

The decision came following an appeal filed by the Italian Hemp Entrepreneurs Association (ICI – Imprenditori Canapa Italia), which represents many cannabis light stores and, too from the country. According to the association's appeal, the government did not collect the necessary scientific opinions to define CBD as a narcotic substance, including that of the Superior Health Council. Furthermore, the ban would go against most European regulations and would annihilate a good part of existing stores. The Court scheduled a hearing to express a definitive opinion on the matter on October 24th.

As in Portugal, the legislative situation regarding CBD in Italy is quite confusing, with different opinions between the parties involved, advances and setbacks in the legality of hemp-derived products. In the case of Italy, Meloni's decree of August 7 annulled a 2020 decree, which in turn blocked a previous decree that made the sale of CBD-based substances illegal in Italy since 2016. After the latest decree, stores selling CBD products in Italy began to suffer seizures by authorities, as both possession and sale of the substances had become illegal. The decision of the Administrative Court of the Lazio Region now reiterates the legality of the CBD and gives a new twist to its legal situation.
