Czech Republic may partially legalize recreational cannabis
The Czech Ministry of Justice has proposed a partial legalisation of cannabis cultivation, allowing adults over the age of 21 to grow up to three plants for personal consumption. The proposal will be submitted to the government and also provides for the possibility of storing up to 50 grams at home and 25 grams outside the home, without any criminal sanctions or administrative offences.
According to Czech online newspaper Novinky.cz, the Ministry of Justice has prepared a preliminary report that will be presented to the Government for consideration. The document includes a proposal that aims to adjust the legal framework to changes in social perception about the recreational use of cannabis and respond to calls from addictologists, who have long advocated for lighter penalties for self-cultivation.
Currently, in the Czech Republic, punishments for small-scale farmers are often more severe than for crimes such as rape or murder. This has been the subject of harsh criticism to the judicial system and the proposed amendment aims for more balanced and less punitive regulation for those who grow cannabis.
The proposed changes include raising the legal amounts for possession and cultivation without committing a crime. The proposed new limit states that three cannabis plants and up to 100 grams of dried cannabis stored at home, or 50 grams of cannabis stored outside the home, do not constitute an offence. For cultivation and possession above these limits, the maximum suggested penalty is six months in prison, significantly lower than the penalties for other narcotic substances.
The proposal also includes an increase in fines for drug-related offences, which could reach up to 50 Czech crowns (around 1973,33 euros), and changes to the minimum sentences for illegal drug production, reducing the number of years in prison in serious cases. The government is expected to decide soon on the implementation of the law, which could range from a regulated market, cannabis clubs or simply allowing self-cultivation of up to three plants, with the latter being the most likely option to be implemented.
