Netherlands: Government wants to regulate legal vacuum of coffeeshops

Dutch ministers set up a four-year trial project in some districts in the Netherlands to assess requirements for the supply of cannabis to coffee shops.

The Dutch government thus intends to legally frame the marketing of cannabis, something that, despite being tolerated in the Netherlands, is illegal.

There are more than 570 Dutch establishments dedicated to the sale of cannabis, spread across 103 cities in the country's district (the Netherlands is made up of 380 districts).

Despite the tolerance granted by the authorities for several years to the sale of cannabis to the public under certain conditions, the supply in stock of these establishments was not legally permitted, which created an illicit market in production and wholesale sales. of cannabis in the Netherlands.

Pilot project takes place in 10 districts
This experimental phase of the pilot project will cover up to 10 districts, which will be chosen according to location and size, and will examine impacts on public health, crime, public safety and other issues that may arise.

An independent advisory committee will review and define district selection criteria, cultivation methods and supervision and inspection systems by the end of May this year.

The bill, required to circumvent the legal constraints of the Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances of 1988, will be presented to Parliament before the summer of 2018. The draft version of the new law has already been sent to several interested parties, such as the Association of Municipalities, the Attorney General's Office and the Judiciary Council. The law will also be accompanied by a regulatory decree that sets out specific requirements regarding the cultivation and sales of cannabis.

The results of this experimental project will be independently evaluated.
