Maltese cannabis users will be allowed to grow their own plants at home and legally carry up to 7 grams for personal use, according to a reform proposal released by the government, announced the Times of Malta.
The document, entitled “Towards strengthening the legal framework on responsible use of cannabis – White Paper”, includes several proposals, which are now open for public consultation and submission of others, opening the door to the creation of a legal market for cannabis flower and seeds. remember that Malta awarded the first medical cannabis production license last January to Aphria.
Robert Abela, Prime Minister of Malta, told the Times of Malta that the reforms aim to face a reality that “has been with us for years, but no one has addressed it”. “I have always been clear about this: it is unacceptable for a person caught with a joint for personal use to end up in the police station, arrested, and then be prosecuted in court.” Abela added that the reforms introduced by the government in the past “clearly have not been enough” and this has resulted in the “blooming of the black market”.
In the opinion of the Prime Minister of Malta, this white paper can serve as a “model” for other countries that are considering legislating the responsible use of cannabis. Malta thus opens the possibility of the recreational market in Malta, being able to be a pioneer in Europe.
In the White Paper published by the government it is proposed:
– possession of up to 7 grams of cannabis for fully legal personal use;
– transport of between 7 and 28 grams for personal use subject to a drug court fine;
– possession of cannabis is no longer a punishable offence, and anyone caught with cannabis will not be questioned by the police;
– Self-cultivate up to four cannabis plants for personal use, at home, as long as the plants cannot be seen outside;
– Any person with a criminal record, for simple possession of cannabis, will have their record clean;
– Consumption of cannabis is prohibited in public areas and subject to a fine of 233 euros;
– Creating a legal way for users to buy cannabis flowers and seeds.
About when the new rules should come into force, Abela said that he is not yet in a position to give exact deadlines, but assured that the debate will not drag on for long.
“We want a regulated source where people can buy cannabis and its seeds. I believe this will be key to rooting out the illegal market, along with continued enforcement of existing laws,” he said.
