Paula Carvalho in statements to the program Make it Rain or Make it Sol, from RTP2

The President of ACCIP - Association of Industrial Hemp Traders of Portugal, Patrick Martins, and the vice-president, Humberto João Nogueira, sent emails to the General Directorate of Food and Veterinary Medicine (DGAV) and other entities, in reaction to the statements. by Paula Carvalho, Deputy Director General of DGAV, on the program “Faça Chuva, Faça Sol”, broadcast on RTP2.

Cannareporter had access to the emails that those responsible for the association sent, expressing their “repudiation” at the way in which the hemp sector is being conducted in Portugal and transcribe them below.

“I come to reinforce and support the email of our Vice-President of the Association of Industrial Hemp Traders of Portugal (ACCIP) and leave some promises and indications about the various public institutions in a copy of this email.

First, I would like to make it clear that ACCIP has already asked its representative, Dr João Nabais, to file a criminal defamation lawsuit against Ms. Paula de Carvalho. It is very serious to use state institutions to pass on wrong information and that harm hundreds of Portuguese traders and, by extension, our country's economy, even using public channels to do so.

I want to make it very clear that through the ACCIP or even personally, I will prosecute all civil servants who shame the institutions of the Republic, financed in particular by us traders, but also by the Portuguese people. Because our institutions of the Republic do not have to be blamed for the incompetence and/or conflicts of interest of the officials who “work” there.

At the same time, ACCIP is preparing a complete document to be sent to the European institutions on the highly undemocratic practices of some officials of the institutions of the Portuguese Republic, such as: court proceedings without deadlines, arbitrary seizure of material, destruction of crops authorized in the European Union, drug trafficking charges from the Attorney General's Office of traders and farmers (all of them without any criminal record), disinformation on public TV, etc…. when there are already several jurisprudence on industrial hemp in the European Union in identical cases that everyone pretends not to know or openly ignores.

As is the case with the Attorney General's Office that shamefully refused to receive our association, such is the size of the absurd work carried out by the employees of this institution, already tainted countless times by corruption processes that, indeed, remain unpunished!

Employees who admit they don't understand anything about the Industrial Hemp sector but file a lawsuit, employees who ask not to be called to trial under threats of "suffering from amnesia" and who describe the operations they run as "shitty operations", employees who admit that Portugal prefers to be sanctioned by the European Union than to follow the regulations ratified when a Portuguese headed the European Commission, etc… All these statements were made in front of witnesses and we also have numerous recordings that I will have no problem publishing in the media if these absurd and anti-democratic persecutions don't stop!

I reinforce the urgent request to our political parties, in a copy of this email, with which we have already met and all of them in shock with the practices of officials who hide behind the institutions they represent to mask arrests, seizures and unconstitutional accusations. As a Portuguese and European citizen, I will commit myself to putting an end to these persecutions and I will need all the employees who have really decided to enter the civil service to protect Portuguese and European citizens as well as the interests of the Nation!

May justice be done!
Patrick Martins – President of ACCIP”

“Humberto Nogueira, vice-president of ACCIP – Association of Industrial Hemp Traders of Portugal and collaborating member of CannaCasa – Association of Hemp Farmers of Portugal, I hereby declare my and our deep displeasure, following the report on the program 'Make it Rain Make Sun', broadcast by RTP2 on 30/10/2021, I hereby report and convey my/our repudiation:

Humberto Nogueira, vice president of ACCIP, in an industrial hemp plantation. Photo: SocialWeed.co

The delivery of Eng. Paula de Carvalho clearly misleads viewers by stating that in Portugal you can only grow for fiber and for seed, something that is a LIE, a lie that Mrs. Eng. and the public institution it represents insist on transmitting to producers and companies that wish to exploit this culture for 3 purposes: seed, non-psychotropic cannabinoids and fiber.

The rest of Community Europe cultivates for 3 purposes, so it does not have the right to deny national agriculture the same Community law. In addition Ms. Eng. Paula de Carvalho, the isolated CBD molecule is indeed a new food. The whole plant or the whole extracts are considered Cannabis Sativa L. in the form of industrial hemp certified by the EU, an entry that you can also verify in the EU novel food and that has never been revoked, if in these molds CBD is only one component. within the numerous components of the entire plant. I remind you that the DGAV is responsible for authorizing crops, having no relation to the processing of the crop. I also emphasize that “Culture Destination” implies the purpose of cultivation and not the obligation to inform who is going to buy the hemp crop, and your action in this matter corresponds to an illegal collection of data. Attempting to import licensing procedures for medical cannabis production and apply them to hemp has only proved to be confusing, destabilizing and fruitless for growers.

Its performance will be the subject of a complaint in the DGAV's yellow book, either by CannaCasa or by ACCIP – Associação dos Comerciadores do Cânhamo Industrial de Portugal, as well as complaints will be presented to the Ombudsman. Using public TV to spread your narrative, which has only brought us harm since 2018, was without a doubt the lowest of the scams practiced by your institution, an institution that should be at the service of contributors and not lobbies that just want to see medical cannabis in pharmacies and the therapeutic capabilities of hemp in food and well-being are denied to Portuguese consumers – please be aware that your provision has contributed even more to this.

Mrs. Eng. Paula de Carvalho, I have been a producer and consultant of industrial hemp in Portugal since 2017, and in 2018 his former colleague Eng. Teresa Pais Coelho signed an expert opinion on the cultivation of industrial hemp in a greenhouse for flower production with a view to the CBD potential of the Finola variety. At that stage, the drug law was never an argument to prevent cultivation, so there were no changes to the law in the meantime, it is not up to you to refuse authorization requests for the exploitation of the entire plant. In fact, after having confronted eng. Teresa Coelho this year with these facts, Eng. he no longer responded and even left his position at DGAV.

If the same false narrative that is harming national agriculture is verified, we will have nothing left but to reveal the 2018 cultivation documents to the highest authorities in the EU.

Mrs Eng. Ana Paula de Carvalho has read until now the words of someone who lives 100% of this activity and who even puts food on her children's table thanks to the hemp industry. I appeal to you and your institution to stop hampering the production of industrial hemp with baseless actions and without any legal basis. We are not going to stop claiming the rights that the EU guarantees us, especially when our own Nation treats us like drug traffickers — I read your interview for Cannareporter, and I am sorry but you will have to live with a reality of your acts: the DGAV instructed the GNR to visit unauthorized producers who resorted to tacit approval due to the lack of a timely response from the DGAV, so that they were treated as drug traffickers and who are now facing legal proceedings… In the 1937st century they used the same refinement of wickedness of XNUMX (Marijuana Tax Act) to restrict and slow down the evolution of hemp in Portugal.

This is your legacy Mrs. Eng. Paula de Carvalho, arresting farmers and destroying their investments… In the midst of the economic crisis resulting from the pandemic.

Cumprimentos,
Humberto J. Nogueira – Vice-President of ACCIP
